These Terms and Conditions set out the basis on which Rubbish Removal Greenwich provides rubbish removal and waste collection services to domestic and commercial customers. By making a booking, you agree that these Terms and Conditions will apply to all services we provide to you, unless we agree otherwise in writing.
In these Terms and Conditions, the following expressions have the meanings given below:
1.1 "We", "us" and "our" mean the service provider trading as Rubbish Removal Greenwich.
1.2 "You" and "your" mean the customer who requests and receives our services.
1.3 "Services" means any rubbish removal, waste collection, clearance, loading, transport, disposal, recycling or related services we agree to provide.
1.4 "Booking" means your request for services that is accepted by us, whether made by telephone, email, online form or in person.
1.5 "Site" means the address or location at which the services are to be provided.
1.6 "Waste" means the items, materials and rubbish you ask us to remove, including any associated packaging.
2.1 We provide rubbish removal and waste collection services to domestic and commercial customers within our operational area, which includes Greenwich and surrounding locations. The exact service area may change from time to time.
2.2 Our services typically include collection of household waste, bulky items, garden waste, light construction waste and general rubbish, subject to the exclusions in these Terms and Conditions and to applicable waste regulations.
2.3 We reserve the right to refuse to collect any item or material which, in our reasonable opinion, is unsafe to handle, not permitted under waste regulations, or outside the agreed scope of the booking.
2.4 We do not provide specialist hazardous waste services unless expressly agreed in writing. Hazardous items may include but are not limited to asbestos, certain chemicals, solvents, oils, gas bottles, medical waste and certain electrical items that require specialist treatment.
3.1 You may request a booking by telephone, email or through our online enquiry process. A booking will only be confirmed when we have provided you with a confirmation and, where required, you have accepted any quotation we have issued.
3.2 When making a booking, you must provide accurate details about the type, quantity and location of the waste, access to the site, parking arrangements and any other relevant information that may affect the service.
3.3 Any quotation provided before attendance at the site is an estimate only, based on the information you supply. We may revise the quotation once we have inspected the waste and site conditions.
3.4 We may require photographic information or a description of the items to be removed to assist in preparing an estimate for the collection.
3.5 By confirming a booking, you warrant that you have the authority of the owner or occupier of the site to request the services and to allow us access to remove the waste.
4.1 You must ensure that we have safe, reasonable and lawful access to the site at the agreed time. This includes suitable parking for our vehicle as close as reasonably practicable to the collection point.
4.2 Any parking charges, permits or congestion charges related to access to the site are your responsibility and may be added to the final invoice if paid by us on your behalf.
4.3 If we are unable to carry out the service due to lack of access, unsafe conditions or incorrect information provided by you, we may at our discretion charge a call-out or wasted journey fee to cover our costs.
5.1 You are responsible for accurately describing the waste to be collected. If, on arrival, the waste differs significantly in volume, weight or type from that described, we may adjust the price or decline to proceed with the service.
5.2 You must not include in the waste any items that are prohibited or restricted under applicable waste legislation or that we have informed you we are unable to collect.
5.3 We do not accept responsibility for any item removed as waste that you or a third party placed for collection in error. It is your responsibility to ensure that only items intended for disposal are presented to us.
6.1 Our prices are usually based on a combination of the volume, weight and nature of the waste, the labour required, and any disposal or recycling charges imposed by facilities or authorities.
6.2 Any quotation given before the collection is an estimate only and is subject to our inspection of the waste on arrival. We will inform you of any change to the price before starting work and you may choose whether to proceed.
6.3 Quotations are normally valid for a limited period as stated at the time of issue. If no period is stated, a quotation will be valid for 30 days from the date provided, subject to our continued availability and any changes to disposal charges or regulations.
7.1 Unless otherwise agreed in writing, payment is due in full on completion of the service. We may require payment in advance for certain bookings, larger clearances or commercial contracts.
7.2 We accept payment by the methods made available at the time of booking or service, which may include cash, debit card, credit card or bank transfer. We reserve the right to refuse certain payment methods for security or operational reasons.
7.3 For commercial customers with agreed credit terms, invoices must be paid in full within the period specified on the invoice. If no period is stated, payment must be made within 14 days of the invoice date.
7.4 If you fail to pay any amount due, we may charge interest on the overdue sum at the statutory rate permitted under UK law, accruing daily until payment is received in full.
7.5 Title to any waste materials passes to us only when we receive payment in full, subject to applicable waste regulation requirements.
8.1 You may cancel or reschedule a booking by giving us as much notice as reasonably possible. We kindly request at least 24 hours notice where feasible so that we can reallocate our resources.
8.2 If you cancel a booking with less than 24 hours notice, we may, at our discretion, charge a reasonable cancellation fee to cover our costs and any lost opportunity to allocate the slot to another customer.
8.3 If we arrive at the site and are unable to perform the service due to your late cancellation, lack of access, or other circumstances within your control, we may charge a wasted journey fee.
8.4 We reserve the right to cancel or reschedule a booking for operational or safety reasons, including vehicle breakdown, staff illness, or severe weather. In such cases, we will contact you as soon as reasonably practicable to arrange an alternative time. We will not be liable for any indirect loss or inconvenience arising from such cancellations.
9.1 We will use reasonable skill and care in providing the services and will take all reasonable steps to minimise disruption at the site.
9.2 Our staff will not dismantle or remove fixed structures or fittings unless expressly agreed in advance. Any such additional work may be subject to a separate fee and risk assessment.
9.3 We will endeavour to leave the area of collection tidy after the service, but we are not responsible for deep cleaning or for restoring surfaces beyond reasonable sweeping and removal of loose debris.
9.4 Time is not of the essence for performance of the services. We will use reasonable endeavours to attend within the agreed time window but cannot guarantee precise arrival or completion times.
10.1 We operate in accordance with applicable UK waste management and environmental regulations. This includes duty of care obligations regarding the transfer, transport and disposal of controlled waste.
10.2 We will transport and dispose of waste only at authorised facilities or through licensed third parties, as required by law. We may use recycling, recovery, or energy-from-waste facilities where appropriate.
10.3 We may issue or receive duty of care documentation relating to the transfer of waste where required. You agree to provide any information needed for accurate completion of such documentation.
10.4 You must not request us to handle or remove waste in a way that would breach any law, regulation or permit. We may immediately suspend or terminate the service if we reasonably believe you are asking us to act unlawfully.
11.1 You must ensure that the waste is presented safely, without sharp or dangerous protrusions and in a manner that allows our staff to handle it using reasonable care. Where heavy items are involved, you should inform us in advance.
11.2 You must keep children, pets and unauthorised persons away from the working area while our staff are carrying out the services.
11.3 You are responsible for obtaining any consents needed from landlords, neighbours or managing agents for access to the site or removal of items from shared or communal areas.
12.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded.
12.2 Subject to clause 12.1, we will not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or loss of enjoyment arising from the services or any delay in performance.
12.3 Our total liability to you for any loss or damage arising from or in connection with the services, whether in contract, tort, negligence or otherwise, will not exceed the total price paid or payable by you for the specific booking giving rise to the claim.
12.4 We will not be liable for damage to driveways, paths, underground services, cables or other structures at the site where such damage arises from the weight or movement of our vehicles or equipment, provided we have acted with reasonable care and you have authorised or accepted our access onto the property.
12.5 You are responsible for protecting any delicate surfaces, fixtures or items that might be affected by the movement of waste or equipment. We will not be liable for cosmetic damage to walls, floors or paintwork that is reasonably incidental to the performance of the services.
13.1 If you are dissatisfied with any aspect of the services, you should notify us as soon as possible so that we have the opportunity to address your concerns.
13.2 We may request reasonable evidence or information about the issue, including photographs or access to inspect the site, before deciding on an appropriate resolution.
13.3 Any complaint should normally be raised within a reasonable time after the service, and in any event within 14 days, to allow us to investigate effectively.
14.1 We will collect and use your personal information only for the purposes of managing your bookings, providing the services, handling payment and administration, and fulfilling our legal obligations.
14.2 We will take reasonable steps to keep your personal information secure and will not sell or disclose it to third parties except as necessary to provide the services, process payments, comply with legal requirements or with your consent.
15.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the date the revised terms are published or communicated.
15.2 The Terms and Conditions in force at the time of your booking will normally apply to that booking, unless you agree to a later version in writing.
16.1 We will not be liable for any delay or failure to perform our obligations where such delay or failure is due to events or circumstances beyond our reasonable control, including extreme weather, natural disasters, industrial disputes, accidents, traffic disruption, or acts of government or authorities.
17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be deemed severed from the remaining terms, which will continue in full force and effect.
18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our services, shall be governed by and construed in accordance with the laws of England and Wales.
18.2 You and we agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services we provide.
19.1 These Terms and Conditions, together with any written quotation or confirmation of booking we provide, constitute the entire agreement between you and us in relation to the services and supersede any previous agreements, understandings or representations.
19.2 You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these Terms and Conditions or in writing in your booking confirmation.
